Though the oral arguments over the individual mandate and severability were encouraging, we cannot count on the Supremes to kill Obamacare. Opponents must keep fighting it on all fronts.

The most important front right now is to ensure that states do not create the health-insurance exchanges Obamacare needs in order to operate. Refusing to create exchanges is the most powerful thing states can do to take Obamacare down. Think of it as an insurance policy in case the Supreme Court whiffs.

Secretary of HHS admits doubt that Obamacare "exchanges" will be operational by 2014 and likely at least half the states will not have one implemented. Even worse for taxpayers, the $1 Billion allocated to the program will not be insufficient to cover the costs and may require additional taxpayer support. Imagine that; another failed government program running over budget and not being operational on the scheduled date.

Jindal Joins Other Governors in Declining to Set Up Health Care Exchange

From the Heartland Institute...

Louisiana's Republican Governor, Bobby Jindal, has announced his state will not create a health insurance exchange mandated by the Patient Protection and Accountable Care Act.

Other Republican governors, such as Nathan Deal in Georgia, Susana Martinez in New Mexico, Rick Perry in Texas, and C.L. "Butch" Otter in Idaho, have announced opposition, vetoed bills, or issued executive orders as ways to prevent implementation of a health exchange.

Florida's governor, Rick Scott, also a Republican, has stood adamantly against the exchanges.

Michael Cannon explains all the deficiencies and negative consequences of the PPACA and why we need to shut it down and replace with alternatives that will protect what works well in the current system while addressing those areas that truly need reform.  Furthermore, he makes the case for state governors to not initiate the groundwork for their state insurance exchange while waiting for a Supreme Court decision since this is exactly what this administration is counting on.  The SCOTUS decision may very well be influenced by how entrenched the roots of Obamacare have taken.  Complying with the HHS Secretary in laying the groundwork for this new bureaucracy will be counterproductive to states who are resisting the new law.
